Terms of Service

1. Acceptance of Terms
By accessing or using SearchStrata ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms are governed by and must be interpreted in accordance with the Strata Property Act (SBC 1998, c. 43), the Personal Information Protection Act (PIPA, SBC 2003, c. 63), and other applicable laws of British Columbia, Canada.
2. Description of Service
SearchStrata provides AI-powered analysis of strata (condominium) document packages for Canadian properties. The Service includes document upload, automated report generation, health scoring, question answering, and property comparison features. The Service processes documents using artificial intelligence services provided by third parties (Anthropic and Amazon Web Services) as described in our Privacy Policy.
3. Account Registration
You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date.
4. Subscriptions and Payments
- Free plan: Includes up to 3 properties with limited features at no cost.
- Pro plan: $29/month for unlimited properties and full features.
- Agent plan: $79/month for teams with white-label and branding features.
- One-time credits: Single property ($14.99) or 3-property bundle ($34.99) available without a subscription.
Subscriptions are billed monthly through Stripe. You may cancel at any time; access continues until the end of your current billing period. Refunds are not provided for partial billing periods. We reserve the right to change pricing with 30 days' notice.
5. Acceptable Use
You agree not to:
- Upload documents you do not have the legal right to access or share.
- Use the Service for any unlawful purpose or in violation of any applicable law, including PIPA and the Strata Property Act.
- Upload documents obtained through unauthorized access to strata corporation records.
- Use personal information extracted from strata documents for any purpose other than evaluating a strata property purchase or managing your own strata lot.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Use automated tools to scrape, crawl, or extract data from the Service.
- Resell or redistribute access to the Service without written authorization.
6. Uploaded Content and Strata Documents
You retain ownership of all documents you upload. By uploading documents, you grant SearchStrata a limited, non-exclusive license to process, analyze, and store those documents solely for the purpose of providing the Service. We will not share your documents with other users or third parties except as described in our Privacy Policy.
Strata document responsibilities: You acknowledge that strata documents (including but not limited to meeting minutes, financial statements, Form B information certificates, depreciation reports, bylaws, and insurance certificates) may contain personal information of other strata lot owners. By uploading these documents, you represent and warrant that:
- You obtained the documents lawfully, such as through a request under Strata Property Act s. 36 (owner access), s. 59 (Form B information certificate), or as an authorized real estate professional acting on behalf of a prospective purchaser.
- You will not use the Service to identify, profile, contact, or take action against individual strata lot owners based on information extracted from these documents.
- You accept responsibility for ensuring your use of any personal information contained in uploaded documents complies with PIPA.
7. Consent and Privacy
Before using document upload and analysis features, you must provide explicit consent for:
- Data collection: Collection and storage of your personal information and uploaded documents.
- AI processing: Processing of document content by AI services (Anthropic, AWS Bedrock, AWS Textract) for analysis, embedding generation, and report creation.
- Third-party sharing: Sharing of document content with the third-party service providers listed in our Privacy Policy for the purpose of providing the Service.
You may withdraw consent at any time through your account settings or by contacting our Privacy Officer. See our Privacy Policy for full details on your rights under PIPA.
8. Data Retention
Uploaded documents are retained for a default period of 2 years from upload, consistent with the Strata Property Act s. 35 record-keeping requirements. Documents are automatically purged after their retention period expires. You may delete documents at any time before the retention period ends. Upon account deletion, all data is permanently removed within 30 days. See our Privacy Policy for full retention details.
9. AI-Generated Content Disclaimer
Reports, summaries, health scores, and answers generated by SearchStrata are produced using artificial intelligence and are provided for informational purposes only. They do not constitute legal, financial, or professional real estate advice. AI-generated analysis may contain errors or omissions. You should independently verify all information and consult qualified professionals (including licensed real estate agents, lawyers, engineers, and accountants) before making purchasing decisions based on our analysis. SearchStrata does not replace the due diligence required under real estate transaction law.
10. Limitation of Liability
To the maximum extent permitted by law, SearchStrata and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any analysis will be complete or accurate.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our sole discretion. You may terminate your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately, and your data will be deleted in accordance with our Privacy Policy. We will comply with PIPA requirements regarding retention and destruction of your personal information following termination.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, including the Personal Information Protection Act (PIPA) and the Strata Property Act, without regard to conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.
14. Changes to These Terms
We reserve the right to modify these terms at any time. We will provide notice of material changes by email and by posting the updated terms on this page with a revised "Last updated" date. Where changes affect how we collect, use, or disclose personal information, we will obtain fresh consent as required by PIPA. Your continued use of the Service after changes constitutes acceptance of the updated terms.
